1Introduction & Acceptance of Terms
Welcome to the website of Rubi Constructions Services LLC, commercially operating as Rubi Construction LLC ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, digital estimate request forms, and preliminary contracting communications.
By accessing our website, requesting an estimate, or submitting project information, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. For any contracted construction, remodeling, hardscaping, roofing, or painting project, the specific milestones, pricing, scope of work, and warranties set forth in your executed Oregon CCB Written Construction Contract will control and supersede general website statements.
2Oregon CCB Statutory Compliance (ORS Chapter 701)
Rubi Construction LLC is a fully licensed, bonded, and insured general contractor registered with the State of Oregon Construction Contractors Board under CCB #216419. All construction operations strictly comply with the Oregon Revised Statutes (ORS) Chapter 701 and Oregon Administrative Rules (OAR) Chapter 812.
3Scope of Services & Written Estimates
Informational Nature: Online estimate requests, cost guides, or preliminary discussions provide rough planning figures and do not constitute a binding bid or contract.
On-Site Assessment: Binding proposals require an in-person, on-site evaluation by an authorized representative to assess topography, structural conditions, drainage, framing, and utility layouts.
Estimate Validity Period: Written proposals remain valid for thirty (30) calendar days from issuance. Due to regional market fluctuations in building materials (framing lumber, concrete, composite decking, asphalt shingles), proposals unaccepted within 30 days are subject to re-evaluation prior to signing.
4Change Orders & Scope Modifications
In compliance with ORS 701.305, once a written construction agreement is signed, no deviations, additions, or deletions from the contracted scope of work will be performed without an executed written Change Order.
Each Change Order details the specific modification, cost adjustments (additions or deductions), and estimated schedule impact. If unexpected concealed conditions arise (e.g. concealed dry rot, plumbing leaks behind walls, unpermitted electrical, or buried underground obstructions), work in the affected zone will pause until the condition is documented and an approved Change Order is signed by the homeowner.
5Job Site Conditions & Property Owner Responsibilities
- Site Access: Owner agrees to provide continuous, unobstructed access to the work area, driveway, and gates during operational hours (Monday through Saturday, 7:00 AM – 6:00 PM).
- Utilities: Unless agreed otherwise in writing, owner provides operational 120V electricity and running water on site for power tools and cleanup.
- Property Boundaries & Private Lines: Owner is responsible for identifying legal property lines and private buried lines (irrigation, landscape wiring, septic fields, propane lines). Rubi Construction LLC calls Oregon 811 for public utility locates before excavation.
- Safety: Active construction zones present physical hazards. Homeowners must keep children, pets, and visitors clear of active work zones at all times.
6Permits & Municipal Code Compliance
Rubi Construction LLC coordinates, pulls, and manages building and structural permits with local municipal building departments across Washington County, Multnomah County, Clackamas County, City of Hillsboro, City of Portland, City of Beaverton, and surrounding jurisdictions. All construction adheres to the current Oregon Residential Specialty Code (ORSC) and Oregon Structural Specialty Code (OSSC).
7Weather Delays & Force Majeure
Construction in the Pacific Northwest is subject to regional environmental factors. Rubi Construction LLC is not liable for project timeline delays directly caused by adverse weather that compromises safety or craftsmanship, including torrential rain, sub-freezing temperatures preventing concrete curing or roofing adhesion, hazardous winds, or regional ice emergencies. Timeline extensions will match the necessary delay duration without penalty.
8One-Year Limited Workmanship Warranty
Rubi Construction LLC warrants to the contracting homeowner that all labor and craftsmanship provided under an executed contract will be free from defective workmanship for a period of one (1) full year (12 months) from substantial completion.
Warranty Exclusions:
- Normal wear, tear, weathering, discoloration, or fading caused by sun, rain, and time.
- Hairline shrinkage relief cracks in concrete flatwork, driveways, or masonry grout that do not impair structural stability.
- Soil erosion, ground settlement, or shifting beyond contractor control.
- Water damage or rot caused by deferred homeowner maintenance (clogged gutters, direct sprinkler spray against siding).
- Natural checking, movement, or cupping of organic cedar or pressure-treated lumber.
Manufactured products (e.g. Trex composite decking, architectural roofing shingles, siding, and paints) carry manufacturer warranties assigned to the homeowner upon final payment.
9Oregon Construction Lien Notice (ORS Chapter 87)
Under Oregon Construction Lien Law (ORS 87.001 – 87.093), contractors, subcontractors, and material suppliers who improve real property have a right to file a lien against the property if unpaid. Rubi Construction LLC pays trade suppliers and laborers promptly and provides executed lien waivers upon receiving milestone payments from property owners upon request.
10Oregon CCB Dispute Resolution & Right to Cure
Notice and Opportunity to Repair (ORS 701.560 – 701.595): Oregon law requires property owners to deliver written notice of alleged construction defects at least 60 days before filing any legal action or arbitration, allowing the contractor the legal right to inspect and offer repair.
CCB Claims (ORS 701.131 – 701.146): Homeowners have the right to file an administrative complaint with the Oregon Construction Contractors Board against the contractor’s surety bond within one (1) year of project completion or abandonment.
11Governing Law & Jurisdiction
These Terms and any contracting relationship initiated through this website are governed by the laws of the State of Oregon. Any formal legal proceedings shall be instituted exclusively in the state courts located in Washington County Circuit Court, Hillsboro, Oregon.
